GENERAL

All services provided to the customer by our online shop www.smoke.ch are exclusively based on the following General Terms and Conditions. Deviating regulations are only valid if they have been agreed upon in writing between GustoMondial and the customer. Our General Terms and Conditions (GTC) are the basis of a long-term fair partnership. By sending an order you agree to the terms and conditions.

TIME OF THE CONCLUSION OF THE CONTRACT

The offers in our online shop on the internet constitute a non-binding invitation to the customer to order goods in this online shop.
By ordering the desired goods online, the customer makes a binding offer to conclude a purchase agreement. Our online store is entitled to accept or reject this offer by sending an order confirmation. The purchase contract is concluded with the order confirmation, which is sent by e-mail.

PRICES

All prices are in CHF excluding VAT.
The prices shown are final prices per item.
Prices and product ranges are subject to change without notice.

Prices for deliveries abroad
All costs for import, customs and applicable VAT in the recipient country are borne by the customer.

PAYMENT

Payment of delivery within Switzerland:

  • Bank transfer
  • Credit card
  • Against invoice, only for regular customers

Payment of delivery abroad are made in advance. The goods remain the property of GustoMondial until full payment has been received.

SHIPMENT

Delivery area

We deliver to Switzerland and selected countries worldwide. The following countries are excluded from delivery:

  • Afghanistan
  • Belarus
  • Russia
  • United States of America (USA)

Orders with delivery addresses in these countries unfortunately cannot be processed and will be cancelled.

EXCHANGE/RETURN

Our products are subjected to quality control at incoming and outgoing goods. Complaints regarding defective deliveries must be submitted to us in writing within 10 days of delivery and must include a justification.
We ask the buyer to check the condition of the received goods immediately upon receipt; after 10 days the delivery is considered approved. Transport damage must be reported immediately upon receipt. Any further claims of the customer, irrespective of the legal grounds, in particular claims for damages, are excluded.

LIABILITY

Our online store is not liable for damages that have not occurred to the delivery item itself; in particular, the online store is not liable for lost profits or other financial losses of the customer, likewise not for defects or differences in the quality of natural products. If the supplementary performance is carried out by way of a replacement delivery, the customer is obligated to return the goods first delivered to GustoMondial within 15 days. The costs for the return shipment (freight, customs, packaging, etc.) shall be borne by the customer. The return of the defective goods must be made in accordance with the statutory provisions.

OTHER

We have no influence if articles are taken out of the program by our suppliers and are therefore no longer available or have been changed in type and design. A claim for damages due to articles that are no longer available cannot be asserted against us. We reserve the right to change prices of individual items.

DATA PROTECTION

The data you provide will only be used by us to process your orders. Personal customer data is treated confidentially in accordance with data protection legislation and is neither passed on to third parties nor used for third-party advertising or sold. Particularly sensitive data (especially details for payments by credit card) are transmitted in encrypted form for authorization purposes. Our customers can receive current information about news, promotions or activities via electronic newsletter. This service does not oblige to anything, is free of charge and can be cancelled at any time. Our online store does not SPAM with these addresses.

NO SALE TO MINORS/PROTECTION OF MINORS

According to Swiss law, tobacco products and alcohol may not be sold to persons under the age of 18. In case of doubt, GustoMondial may ask you to provide a copy of your identification by email. Upon delivery, the shipping service provider will carry out an age verification. By placing an order on www.smoke.ch, you acknowledge these regulations and confirm that you are legally entitled to make the purchase.

All websites that are linked in any way to www.smoke.ch have been checked for their content. Despite periodic checks, we cannot rule out the possibility of content being published that is not directly related to our product range. We clearly distance ourselves from all abusive content and assume no responsibility for the legality and content of linked pages.

JURISDICTION

The place of performance and jurisdiction is Zurich. Swiss law is applicable.
