All services provided to the customer by our online shop www.smoke.ch are based exclusively on the following General Terms and Conditions. Deviating provisions apply only if they have been agreed in writing between GustoMondial and the customer. Our General Terms and Conditions (GTC) are the basis of a fair, long-term partnership. By submitting an order, you agree to the GTC.
Conclusion of the contract
The offers in our online shop constitute a non-binding invitation to the customer to order goods in this online shop.
By ordering the desired goods online, the customer makes a binding offer to conclude a purchase contract. Our online shop is entitled to accept this offer by sending an order confirmation, or to reject it. The purchase contract is concluded upon the order confirmation, which is sent by e-mail.

All prices are in CHF.
The prices shown are final prices per item.

Prices for deliveries abroad
All import costs, customs duties and VAT applicable in the recipient country are borne by the customer.

Payment for deliveries within Switzerland:

Deliveries abroad must be paid in advance. The goods remain the property of GustoMondial until payment has been received in full.
Shipping
Delivery area
We deliver to Switzerland and to selected countries worldwide. The following countries are excluded from delivery:
- Belarus
- Brazil
- Brunei
- Malaysia
- North Korea
- Russia
- Singapore
- Taiwan
- Thailand
- Turkey
- Turkmenistan
- USA
- Vietnam
Unfortunately, orders with delivery addresses in these countries cannot be processed and will be cancelled.

Exchange/returns
Our products undergo quality control both on receipt and on dispatch. Complaints regarding defective deliveries must be notified to us in writing, stating the reasons, within 10 days of delivery.
We ask the buyer to check the condition of the goods immediately upon receipt; after 10 days, the delivery is deemed accepted. Transport damage must be reported immediately upon receipt. Any further claims by the customer, on whatever legal grounds, in particular claims for damages, are excluded.
Liability
Our online shop is not liable for damage that has not occurred to the delivered item itself; in particular, the online shop is not liable for loss of profit or other financial losses of the customer, nor for defects or differences in the quality of natural products. If subsequent performance has been made by way of a replacement delivery, the customer is obliged to return the goods originally delivered to GustoMondial within 15 days. The costs of the return shipment (freight, customs, packaging, etc.) are borne by the customer. The defective goods must be returned in accordance with the statutory provisions.
Miscellaneous
We have no influence over our suppliers discontinuing items, which are then no longer available, or changing their type and design. No claim for damages can be asserted against us on account of items that are no longer available. We reserve the right to change the prices of individual items.
Data protection
We use the data you submit exclusively to process your orders. Personal customer data is treated confidentially in accordance with data protection legislation and is neither passed on to third parties nor used for third-party advertising or sold. Particularly sensitive data (in particular credit card payment details) is transmitted in encrypted form for authorisation. Our customers can receive up-to-date information about new products, promotions and events via an electronic newsletter. This service is non-binding, free of charge and can be cancelled at any time. Our online shop does not use these addresses to send spam.
No sale to minors/protection of minors
Under Swiss law, tobacco products and alcohol may not be sold to persons under the age of 18. In case of doubt, GustoMondial will ask you to send us a copy of your ID by e-mail. The shipping service provider carries out an age check upon delivery. By placing an order on www.smoke.ch, you acknowledge these provisions and confirm that you are entitled to make the purchase.

All websites linked in any way to www.smoke.ch have been checked for their content. Despite periodic checks, we cannot rule out that content is published that is not directly related to our product range. We expressly distance ourselves from all abusive content and accept no responsibility for the lawfulness and content of linked pages.
Place of jurisdiction
The place of performance and jurisdiction is Zurich. Swiss law applies.
